Patent Law Year in Review – Preparing presentation for DunesCLE in Las Vegas

It’s that time of year again…I’m headed out to Las Vegas later this week to give a patent law update presentation at the Current Issues in Patent Law 2008 edition of DunesCLE.

I’m working on the presentation today and will make it available for download next week.

Here’s the outline:

1. Update on “Patent Reform” legislation

- Patent Reform Act of 2007 – S.1145 (“The Leahy-Hatch bill”)

- Patent Reform Act of 2008 – “The Kyl bill” (Pharma gets its say in the waning days of the 110th Congress)

2. Update on Administrative reforms

- Cooper v. Dudas – ground rules re Chevron deference in Tafas

- Tafas v. Dudas – a background and current status of the suit against PTO for the now-infamous continuation rules package

- New Rules of Practice Before the Board of Patent Appeals and Interferences

3. Selections from the bench

An overview of several key developments in patent case law, including opinions from the Court of Appeals for the Federal Circuit, Supreme Court petitions for certiorari, and decisions from district courts.
